CURACAO GOVERNMENT IS WORKING WITH THE NETHERLANDS TO HELP UNDOCUMENTED IMMIGRANTS TO RECEIVE PROTECTION

Willemstad, Curacao. On October 11, 2021, Amnesty International released a devastating report on the Curacao government, where they were denying protection to people fleeing the Venezuelan crisis. The publication became a local issue and to this day the government appears to be working on its image with the international community. Among other things, Amnesty expressed: “The Curaçaoan and Dutch authorities have violated the rights of Venezuelans seeking international protection in Curacao, Amnesty International said today in the new report, Still no Safety: Venezuelans denied protection in Curacao. The organization documented 22 cases of Venezuelans, including children, who have been subjected to human rights violations such as automatic detention under inhumane conditions, ill-treatment, family separations and the denial of their right to seek asylum.”
AMNESTY INTERNATIONAL INVESTIGATIONS IN CURACAO
During an interview, Curacao Minister of Justice: Mr. Shalten Hato (MFK political party) expressed the following: “We respect the work of Amnesty International. We must have a watchdog to watch. So that is not a problem for us as a government. The point is that when you do certain investigations, they need to be stabilized within the context! It can't be, where you come and do an investigation, getting in touch with the undocumented people in our country and on top of that, you don't involve (betrek bij) the departments of concern, who work every day with these undocumented people. Why? When you investigate, you should give both sides space to express their point of view. And that is one of the concerns (preokupashonnan) raised by the Minister of Justice.”
Hato continued: “In addition, as the country of Curacao, we are bound by International Treaties, we are a state of law, we respect the rights of all, including the rights of the undocumented. So, in other words, when a person makes a request to receive protection, we must ensure that we assist (atende) these requests.”
Hato went further: “What happened? In the past, it was like this, that there was a commission to handle these requests, after a while, for one reason or another, the commission was not working optimally. At this time, when Mr. Pisas sat down (became Minister of Justice), he immediately went down the path of being able to bring the commission back on its own two feet so that the commission can start dealing with petitions for optimal way. On top of that, as a the country of Curacao, we got help from IND, which stands for Immigration and Naturalization Service (Immigratie en Naturalisatiedienst) in the Netherlands, to help us deal with these petitions. So right now, as we speak, we have people from IND working in Curacao, helping with these requests so that we can deal with those things that are falling behind as well. Why? Because the people who until now have no answer, are in an uncertainty (insertidumbre)! And that is something that is not pleasant! We have to treat everyone as they are supposed to be treated.”

WHAT IS A WATCHDOG PERSON?
According to the Dictionary, it is: "a person or group of persons that acts as a protector or guardian against inefficiency, illegal practices, etc." What does Amnesty International do? According to Amnesty,: "Amnesty International works independently and impartially to promote respect for all the human rights set out in the Universal Declaration of Human Rights. Amnesty International believes that human rights are interdependent and indivisible -- all human rights should be enjoyed by all people at all times, and no one set of rights can be enjoyed at the expense of other rights."
OUR LAWS REGARDING IMMIGRANTS
According to Hato: “There are treaties for human rights, those new and in those in development. You have the National ordinance admission and expulsion (Landsverordening toelating en uitzetting), that is an antique law, which is one of my priorities, to work on it! Apart from that, you have the management that we carry out when it comes to the eviction of admission (toelating uitzetting), the so-called; reinsertion (herdienning insertie), which is also an old management, that is, since 2006, we are busy dealing with it. It is so, that here and there, there are some changes, from what occurs to me is that the last big change was in 2019, but, at the moment, that is also in the pipeline so that we can come with a new management. Also we have the admission decision (a written decision by an administrative authority, containing a legal act under public law) (toelating besluit), that is also antique and that is also in the pipeline for us to bring about.”
