Apparently, a part of the Curacao community, worries that the government may use the law of emergency (noodwet) in case protest and uproar rises once more, because of the introduction of the concept law of; COHO. With the law of emergency, the government would be able to instruct the authorities to keep the public order, and more. Within the community, it is unknown why the government reactivated the law of emergency.    A RESPONSIBLE GOVERNMENT During an interview a local lawyer, Mr. Rutsel Martha commented on the issue, saying the following: “Well, I think that a responsible government, would not work upon scenarios, where they know it would generate discord in the community.”  After it was informed that the Prime Minister, Mr. Gilmar "Pik" Pisas (political party MFK), appeared to have agreed with COHO, Martha went further: “Maybe! But remember, at the end of all, Parliament is the one who has the last word on this issue!” TRANSLATION: [Felicity: 05% - Fidelity: 95% ]  The concern is that the Prime Minister has its 9 member of Parliament supporting his governance, thus making it a greater possibility for the Curacao Parliament to vote pro and bring the COHO law into fruition. In 2020, when the law was treated in Parliament, some people believed the law to be a slavery law, because in their views, this law could take away all fundamental rights from someone. The government believe that, the law is to prevent a crisis from worsening. The Emergency law has resurfaced, although the Curacao Constitution of 2010, states in article 96 how and when the state of emergency can be declared, which must be defined by national decree.  Article 96: 1. ordinance shall determine in which cases to enforce the export or internal security by national decree by the ordinance as such to appoint state of emergency can be declared. The ordinance regulates the consequences. 2. Such regulation may deviate from the provisions of the Constitution concerning freedom of the press, freedom of association and assembly, as well as the inviolability of the home and the privacy of correspondence. 3. The Staten van Curacao decide immediately after the declaration of a state of emergency and furthermore, as long as it is terminated by national decree, whenever they deem necessary, concerning the continuation thereof.
