TACKLING ILLEGAL BEHAVIOUR IN BUSINESSES

Willemstad, Curacao. March 23rd, 2022. The inspector of the Curacao Tax Accountant Foundation SBAB (in Dutch: Stichting Belastingaccountantsbureau), Mr. Angelo Pichardo, spoke about inspections and controls on business and how the searching procedure happens on a regular basis.
INSPECTION PROCEDURE
Among other things, Pichardo stated: “Good, I would like to explain it like this, because in a press release (komunikado) that was in the press, we got a lot of claims, stating, how is it now, that SBAB will start (inspections), where it needs to be said before executing control/inspections etcetera, etcetera. Then we have to say, that this was interpreted erroneously. It is not so, as it is being said outside (amongst the society). We from SBAB have two systems of control. We have the system where we announce the control/inspection, we have one that we call it, the regular investigations (onderzoeken) which we do. These are assignments (opdrachten) that comes for investigations (onderzoeken) to be done at companies, businesses that are registered in Curacao. It can be a private business, a Public limited company (NV), a Sole proprietorship (eenmanszaak), a private limited company (BV) etcetera. That goes like this, we sent a letter in advance, where it is announced that there will be investigations (onderzoeken) at the business. After that, we make an appointment, the conversions arrive and then we do the investigation (onderzoek), base on for example, on your declaration of profit tax, payroll tax, sales tax of the last five (5) years. We do a control, then a report is made etcetera, etcetera. That's how it goes. The other system of control that we have is the observation displacements (waarneming verplaatsingen). Those happen unannounced (onaangekondigd).”

PAST INSPECTIONS
It is estimated that Curacao has more than 15.000 illegal immigrants. SBAB has inspected and raided many establishments and found illegal workers. The fine involved for hiring illegal workers could range from 4.000 to 100.000 guilders.
In 2021, the SBAB inspector did indicated that “this way Curacao workers don't get a chance”, referring to the fact that some business owners contract illegal workers instead of locals.
