MINISTER OF FINANCE; GIJSBERTHA AND THE CENTRAL BANK ACCUSED OF VIOLATING CURACAO'S BANKING LAWS

  

CARLOS MONK VERSUS KENNETH GIJSBERTHA; POLITICAL BOXING?

Willemstad, Curacao. Collaborator of the political party KdNT and President of The Foundation Hustisia pa Un i Tur. Mr Carlos Monk, declared; during a local radio  interview; that the minister of finance has violated the law once more. Monk claimed that the Central Bank received an offer from APC to purchase GiroBank for 75 million guilders, the Central Bank sent a letter that denied  APC's purchase request. The letter was signed by the President of the Central Bank, Richard Doornbosch and the Minister of Finance. Mr. Monk illustrated that the minister of finance can not sign a decision of management with the Central Bank, and in his opinion, that is wrong and the Bank Status is being violated on what arranges the functions of the Central Bank.


CARLOS MONK'S STATEMENTS ABOUT MINISTER OF FINANCE; KENNETH GIJSBERTHA AND THE CURACAO AND SINT MAARTEN CENTRAL BANK 
    Monk stated in the radio interview: " A total craziness! In the process of the purchasing of Giro, APC sent an offer to the Central Bank and the Central Bank denied this, we will not go in the details/content of how it went with it." 

Monk disclosed:
"The point is that the letter that the Central Bank sent with their rejection, with their stand of rejection was signed by the president of the Central Bank also the minister of Finance. Something that is totally, totally illegal! It is wrong!" 

Monk asserted:
"Why is it wrong? If you read our Bank Status and The National Ordinance Supervision of BOD (Dutch: Landsverordening Toezicht van BZV) and Banks, you see that, rightly these laws try to put the banks as autonomous as possible, as independent as possible because your decisions should be independent. So much so, that Article 18 of your Bank Statue, tells you, that it is an obligation that the member of the council of Commissioner as members of the council management, can not take instructions from any government.

Monk further articulated:
"In the same article it tells you also, that the government is obliged to respect this also! So there is an obligation on the side of the members of the management of the Central Bank to not take instructions from the government, but the government as well; can not give them instructions! The government can not influence them in their management!"

Monk emphasized:
"And by singing this letter; practically, the minister of finance is putting himself at the equal position as member of management from the Central Bank, as he is a participant in the decision making of the Central Bank on matters dealing with the Central Bank. And, it is something totally; totally wrong!"

Monk stressed:
"Here, the minister of finance, violated this law! On the other side, you have the risk; where right now, the depositors of Giro or the Account Holders of Giro that already did started a case against the Central Bank and they lost, right now, they can start a case on the government and claim the government on the responsibility on the money that they were suppose to get from APC!"

Monk revealed:
"Why? Because the government put itself responsible for it. Remember; here, the government by the Minister of Finance is rejecting an offer of 72 million, and this 72 million could have been use to pay certain amounts for those that have their money at Giro. And the government rejected it! So the government put itself responsible for the tonality. And, the risk is that, because the Minister of finance, in an unusual form signed a letter, he is putting the country at risk on a claim from the Giro depositors!"

Monk stated:
"And one thing you need to have into account, the Central Bank, in the Bank Statutes; because, it is functioning autonomously, what did it do? What did it stipulated, what is said in the Bank Status? Both members of management and members of commissary, can not be put on possibly liable personally, which means that they are exonerated from certain claims. Members of Management, council of management and council of commissary. There, it is not writing about the minister of finance. Which means, if the minister of finance, take a decision together with the Central Bank, it is wrong. It affect others, he can be put possibly liable! He is not exonerated! And, that is why it is a craziness what Mr. Gijsbertha did!"

Monk also expressed:
"Already in the past the minister of finance violated bank status, in the matter of quantity of minister, he took personal and confidential information of the person and published it etc. He already violated secrecy of the Central Bank!"

Monk elucidated:
"To be able to correct this matter, the first thing that must be done is that the finance minister needs to submit his resignation!"

Monk promulgated:
"He needs to submit its resignation! Because; you can not continue with a minister of finance that violates the law! Remember, two months ago, what did they do? The minister of finance approved to increase his own salary, violating our stats scheme, which tells you that this must happen by a national ordinance! And like that, I can mention more things; where they violated the law. You can not continue with being the finance minister like this!"

Monk asseverated;
"He must submit his resignation! The cabinet must give him his resignation. Because; he is forming a risk for the country. Risk, a financial risk!

Monk declared:
"You have two people at the top of your countries finance, in a financial crisis of economical liquidity, where they do not know what they are doing. They are hurting third parties. Where they know if they have taken the bid from APNA, the 75 million, you could have given it to the Giro depositors and you could have start your economy on the liquidity part in your economy? That also was not done!"

Monk ventilated:
"Expect a claim from the Giro account holders! Expect a claim against the minister of Finance! Because; he violated the law! And expect that in the future, the minister of finance could be put hopefully liable if something goes wrong with the Giro money once more!"

Monk also snitched:
"There was no correction from the Council of Ministers, from the parliamentarians; nor from the minister of finance himself!"

Monk further affirmed:
"No correction will come neither! He can also expect that a complaint will come against him for the crime that he committed!"

Monk continued:
"In the penal code of our country in article 2:44, it tells you that if your Minister, concisely, violate laws of the country, Regulations, Decisions etc. that carries with it four years of prisonThat is our penal code! He did it again, once more!"

Monk emphasized: 
"Naturally space will be given for a correction! But; we know already, he gave public declarations, that he did not do anything wrong, saying simply he needed to change the logoThen he will need to explain that to the criminal investigation department!"

KENNETH GIJSBERTHA RESPONDED TO MONK'S ALLEGATIONS 
    When asked about the matter and message of Carlos Monk, Kenneth Gijsbertha; Curacao's Minister of Finance; professed: 
"I will not give any type of value to Mr. Monk, who bring these things forward because they are things without head and without feet!"

Gijsbertha stressed:
"And if every time he believes that there is violations, I think there are complainants that must be submitted!
Financed Minister; Kenneth Gijsbertha preached:
"We are in a democratic country, walk the way and submit the complaint. I am convinced that everything that took place, judicially is completely rightly done! And as such, then additionally, I think I will stop, for sure when something small, a small fraction all the time, its the one coming forward!"

Gijsbertha enunciated:
"I will keep debating with parliament members, whatever they have, they can ask questions. But for sure; people, I mean, everyday are about negativity, what comes out of their mouth, I want to ask you for your indulgence."

In his final remarks; Gijsbertha confessed:
"I will not give Mr. Monk no value for sure; which has a lot of nonsense in his head!"
